The K-1 visa is known as the fiance visa. It is one of the most commonly requested visas for entering the United States.
The K-1 visa allows the fiancé of a US citizen to enter the country for 90 days so they can get married. The foreign national can then apply for permanent residence (known as a green card).
Most K-1 visa applications are approved. But it’s good to know why they can be denied. Keep reading to find out more about these fiancé visa applications, and the mistakes to avoid.
1. A Poorly Prepared Form
Sometimes something small can lead to your application being declined.
First, you will have to fill out an I-129F form. Simple errors and omissions can lead to rejection. You can resubmit the form, but this will cause a significant delay to your K-1 fiancé visa application.
The person filling out the I-129F form must be a US citizen. Even an application by a lawful permanent resident will be denied.
To make things faster and easier, make sure you read the I-129F instructions carefully. All of your answers need to be truthful and accurate.
If you have any questions or concerns, you can discuss your application with an immigration lawyer.
2. Not Enough Evidence of a Genuine Relationship
K-1 visa applications are heavily scrutinized by immigration officers. As part of the visa application process, you must provide evidence of a genuine relationship. This is part of the I-129F form and the K-1 interview.
You must have met in person at least once within the last two years. Proof of this can include photographs, accommodation reservations, and tickets.
You must plan to marry within 90 days of the foreign national entering the US. As well as this, you must make sure that you can legally marry in the specific state that the wedding will be held in.
Some other reasons for fiancé visa denial include:
- Significant age difference
- Different religions
- Significantly different cultures
- No common language
- Getting engaged shortly after meeting for the first time
- Little time together in person
If immigration officers raise any of these questions, you must be able to explain and prove that your relationship is a genuine one.
3. A Person Is Inadmissible
Some foreign nationals are not eligible to enter the US, regardless of which visa they apply for.
A person will not be granted a K-1 visa if they:
- Have a specific communicable disease, such as tuberculosis
- Are addicted to illegal drugs
- Have a history of involvement with terrorism
- Have committed crimes of moral turpitude, stated on the I-129F form
A foreign national applying to enter the US must also prove that they are unlikely to require or request needs-based government assistance.
The US citizen who is making the application may be asked to prove they have enough income that the immigrant will not need to receive public support or welfare.
