Your insurer rejected your claim, and you don’t know what to do next? You are not without options, even after a rejection in writing. Most policyholders assume a rejected claim is the end of the road. It usually is not.

Every insurer in India must run an internal grievance process, and if that fails you, a free government body called the Insurance Ombudsman exists specifically for this situation. It can order compensation up to fifty lakh rupees, at no cost to you. This article walks through exactly how to raise a complaint and take it to the Ombudsman if needed.

Start With Your Insurer’s Grievance Redressal Officer

Every insurer is required to appoint a Grievance Redressal Officer, or GRO, to handle policyholder complaints directly. This is always the first step, regardless of how frustrated you feel about the original decision. Send your complaint in writing, by email or through the insurer’s online portal, and keep a clear record of the date.

Insurers are expected to respond within a set number of working days, and this response becomes important evidence later in the process. You cannot skip this stage and go straight to the Ombudsman. The legal rules require you to exhaust it first.

What to Do If the Response Is Unsatisfactory

If the GRO rejects your complaint or they just do not write back on time, you do not need to accept that outcome quietly. This is the time when you can take the matter further beyond the insurance company. Make sure you keep all the papers that have to do with the case, like the form you filled out when you first made a claim, the letter that says your claim was rejected, and any letters or emails you sent to the GRO. These records form the backbone of your case at the next stage. Missing paperwork for any comprehensive car insurance is one of the most common reasons a genuine complaint stalls later on.

Filing a Complaint Through the IRDAI Portal

Before reaching the Ombudsman, you can also register your complaint through IRDAI’s own grievance platform. This step is optional but often speeds things along, since it puts your complaint on record with the regulator directly, not just your insurer.

  • File the complaint online through the Integrated Grievance Management System.
  • Attach copies of your policy, claim correspondence, and the GRO’s response.
  • Track your complaint status directly through the portal.
  • Use the IRDAI helpline for guidance if you are unsure how to proceed.

Who Can Approach the Insurance Ombudsman

The Insurance Ombudsman is an independent body set up specifically to help people who have problems with their insurance companies. They resolve disputes between policyholders and insurers, without the cost or delay of a courtroom. You become eligible when you have already talked to your insurance company, and you remain unsatisfied with the outcome. There are seventeen Ombudsman offices spread across India, each covering a defined region, so your complaint goes to the office nearest to your policy’s jurisdiction. Motor insurance disputes make up a meaningful share of the cases these offices handle every year, so you would not be alone in bringing one.

What the Ombudsman Can Do

The Ombudsman can handle disputes valued up to fifty lakh rupees. They can:

  1. direct your insurer to settle a claim
  2. refund a premium,
  3. correct an unfair decision

The process usually begins with an informal mediation attempt. Many disputes settle at this stage without needing a full hearing. If mediation fails, a formal hearing follows, and a written order typically arrives within around three months. The service costs nothing, and you do not need a lawyer. Hearings are kept deliberately informal. So, you can explain your case in plain language, not worrying about legal terminology.

Time Limits You Should Not Miss

A few deadlines matter more than most people realise once a dispute is underway, and missing one can undo months of otherwise solid effort.

  • You generally have one year from your insurer’s final rejection to approach the Ombudsman.
  • Delays are sometimes accepted with valid reason, but this is not guaranteed.
  • Complete your insurer’s internal grievance process first, since skipping this step can get your case dismissed.
  • Keep dated copies of every letter or email exchanged with your insurer.

Documents Worth Keeping Ready

Having the right paperwork in order before you file speeds up every stage of this process.

  • A copy of your policy document, including all add-ons and endorsements.
  • The claim form and any supporting bills, photos, or repair estimates.
  • The insurer’s written rejection or delay in responding, dated clearly.
  • Any prior correspondence with the GRO, including reference numbers.

Choosing the Right Cover Reduces Disputes in the First Place

Many disputes trace back to gaps in coverage that only become obvious at claim time. A properly structured comprehensive car insurance policy, matched honestly to your actual usage and vehicle value. This way, there will be far fewer disputes than a policy bought purely on price. Compare car insurance quotes carefully before you buy. It is one of the simplest ways to avoid the Ombudsman at all.

What Happens If You Are Still Unhappy With the Outcome

If the Ombudsman’s decision still does not satisfy you, there are things you can do. You can still go to a consumer forum or a civil court. The Ombudsman’s decision does not stop you from taking any legal action.

Final Thoughts

A rejected claim does not have to be the final word. India’s grievance system, from the insurer’s GRO to the IRDAI portal to the Ombudsman, exists precisely for situations like this, and it costs you nothing to use. Keep your paperwork organized, follow every step in order and do not think that a first rejection is final. Most disputes that go to the Ombudsman are settled within a month, usually in the policyholder’s favour.
