Personal injury may be physical or emotional and can happen to you at any time. These injuries cause pain, loss, and can be frustrating. A personal injury attorney is required to help you get some monetary compensation after establishing your legal grounds for a personal injury claim. Seeking help from professional law firms like Page & Eichenblatt, P.A. can help you establish the level of injury and the monetary amount you need to attach to your personal injury claim using 3d forensic animation.

Personal injury occurs when you get injured because another person or company was negligent.  That can be in various ways, such as; auto accidents, medical malpractice, truck accidents, ridesharing accidents, defective products, dog bites, motorcycle accidents, and more.

You’re legally entitled to compensation from the party that caused you injury any time you’re injured. Compensations may vary depending on the circumstances surrounding the accident. Your personal injury attorney may choose to agree on the amount of compensation on an out of court basis. The case may be taken to a judge or determined by a jury after a civil trial.

 Types Of Compensation
Some of the types of compensation (damages) that your personal injury attorney can help you include; economic damages and non-economic damages

Economic Damages – Also known as special damages are losses that the party at fault compensates you. When you get injured in an accident, you’re required to continue on medication or treatment for a long time. Economic damages cover the amounts you spend or will be required to spend in the future due to your injury. It includes any other damages to which a dollar amount can readily be attached; it is intended to cover “out of pocket” amounts you spend concerning your injury. These damages include;

Medical expenses – When you get injured, you often require medical treatment that can sometimes be costly. You’re entitled to compensation for the medical bills you incur after the injury and the expenses you expect to incur after the case is settled. Some of the medical expenses include; hospital stays, X-rays, physical therapy, massage therapy, emergency room visits, surgeries, prescriptions, Chiropractor therapy, and more.

Loss of earnings – Some injuries can cause you to lose your job or source of income. Depending on the injury level, you may not be able to go to work for a while, or you may never go to work again. The amount of compensation will vary, but either way, you are entitled to some payment.

Property damage – If your car got wrecked in an accident caused by another person’s negligence, you deserve to be compensated. Property damage covers any property that you may lose as a result of a personal injury.

Non-Economic Damages – This type of compensation is also known as general damages. Sometimes a personal injury may be experienced by pain and suffering, anxiety, stress, and emotional distress.

Pain and suffering – The court will require clear proof of pain and suffering based on a verified document. An insurance company will also accept your report of pain and suffering if it is part of your medical record. Though there is no hard-and-fast rule for how insurance companies arrive at the amount to pay for pain and suffering, some have the formula to calculate the level of pain and suffering, such as multiplying the bill amount by three.

Another method of determining pain and suffering is called the “per diem,” which is Latin for “per day.” You use your actual daily earning rate and multiply it by the number of days you are away from work due to the injury sustained.

Stress and anxiety – Work can be overwhelming, especially if you try to achieve more than is humanly possible within a specified deadline. With companies pushing their employees to better results and better pay, you are bound to push yourself beyond what your body can accommodate yet without the desired expectations.  That results in stress and anxiety.

Though you are entitled to compensation for stress-related issues caused to you as a result of your employer, it can be a difficult claim to pursue. You will have to prove that your employer has neglected to care for you, as is required by law. You’ll have to prove that your illness is a result of your working environment and your employer’s inadequacy to protect you.

Conclusion
To get maximum benefits out of your personal injury claim, you need to have a smart personal injury lawyer to look into the details of your injury and help you build a strong case against the obligation. Some insurance companies take forever to compensate valid claims, or they may not agree to the claims. With the help of an excellent personal attorney, you are bound to achieve the best out of your personal injury claim.
