Litigation is a process of going to court to prosecute or defend a case. While it ensures that the decision is enforceable by the law it is often the most expensive and time-consuming of all. It is a last resort because legal processes are a contest in most instances.

  • Clear Contracts: Proper contracts are those contracts whose clauses and conditions are well articulated and whose party’s roles are well defined to avoid future misunderstandings.
  • Documentation: Documentation of all the conversations, and the contracts as well as the work done in the project is always useful when making your stand in a court of law.
  • Choosing the Right Approach: Choose a conflict resolution approach that fits the level and severity of the conflict, and the interdependence between the conflicting parties.

Disputes are part of the construction process, and construction projects are by their very nature complex. However, with a clear understanding of Forensic Consultant methods and proactive measures, conflicts can be resolved efficiently and amicably.
