David Mitchell is getting ready to sue Douglas County attorney Don Kleine, detective Robert Wiley, Game Room owner Chris Thompson, and ex-deputy Douglas County attorney Gary Olsen in federal court. Attorney Michael Cannon said, “We intend to file a multi-million dollar case against many parties,” representing David Mitchell. For the harm done to my client’s good name and his company’s reputation in the gaming industry. Both Mitchell and his lawyer insist that they have solid proof that they were unfairly targeted for prosecution and that a conspiracy was at play. Cannon told us, “I’m putting together a legal team to seek redress for David Mitchell and his company, Gamers, from everyone who has wronged them.” Since we will be facing a unified foe, we, too, need to field a group of fighters. Since this is our one chance, I want to make sure everything goes well. This case has the potential to be the largest ever won in Omaha, Nebraska.
Police and municipal detectives in Omaha have been attempting to silence David Mitchell ever since he was acquitted of three felony charges, but he has been having increasing success in speaking his tale. This past year, a Douglas County district court jury found the ex-Omaha city council candidate and activist not guilty of sexual assault. In 2020, Mitchell was accused of the two offenses, for which no proof was ever uncovered. The third charge, of burglary, he successfully dismissed in 2022.
Mitchell added, “Despite repeatedly dragging my name through the dirt, the local media has done nothing to clear my reputation.” TV stations like KETV, WOWT, KMTV, and Fox 42 have ruined my faith in the media in my eyes after they let this story go national without clearing my name. Now I suspect that the Omaha Police Department and Don Kleine’s office have me banned and that all local news media outlets play to the same tune. Mitchell also states that a major production firm is now filming a documentary on his time spent in Omaha, NE. When the work is done, he will let us know, he promised.
Omaha is plagued with injustice, and Mitchell’s tale is only one example. It’s terrifying to think that at any moment you could be arrested for a crime you didn’t commit, your name would be splashed across all local media coverage, your bond would be set at a million dollars, and you’d have to pay an insane amount of attorneys’ fees before the media would clear your name. Mitchell believes that he is still being harassed because of the three allegations for which he was found not guilty and still does not have a criminal record. Mitchell said, “Every single day, my family and I get hateful texts. Even if the courts have exonerated me, the public still believes that I am guilty. If I love my wife and children, I must leave Nebraska.
Michael Cannon, Mitchell’s attorney, has told us that they are the least compelling accusations he’s ever had to fight against in his fifteen years as a criminal defense attorney. Cannon adds, “I don’t know how these accusations were ever approved.” There is not a shred of proof, and yet my client’s reputation has been smeared. My client has been subjected to an unfair and defamatory media narrative, and Detective Robert Wiley is completely to blame for this. He provided them with fabricated and tampered-with evidence that falsely implicated my client in a burglary. I want recompense for David Mitchell’s suffering.
