CBD in Europe: what the law says!

Is trading and consuming cannabidiol permitted or illegal? Here is what the European legislation indicates and what is granted in most countries in the European Union.

2020 was a crucial year in terms of regulation for CBD (namely cannabidiol), known to the general public as “light cannabis”, a non-psychotropic substance obtained from cannabis.

The European Court has issued a historic verdict following a hard-fought legal process. As a result,s it is established that no member country can prohibit the trade of CBD produced in a European state by law if extracted from cannabis Sativa.

So, the whole world is wondering about CBD. But at what point is the legislation not only in Europe?

CBD and THC: differences

Before observing how and to what extent Europe and other countries have legislated on the subject, a clarification is required on what CBD is and the differences between THC. Both of them are substances and active ingredients extractable from hemp. However, the difference is substantial. While THC, in fact, is considered a psychotropic substance, the principle that we could vulgarly define as a dopant, CBD has totally different effects.

Let’s see what is allowed and not allowed on our continent and in other European Countries.

As mentioned above, cannabidiol in Europe is considered a legal substance and, therefore, is marketable and can also be used for food purposes, including:

  • Hemp and cannabis seeds
  • hemp seed flour
  • CBD-based gummy candies
  • CBD oil

According to European legislation dating back to 2013, cannabis Sativa that can be marketed must contain a THC concentration of less than 0.2%.

So, let’s see how countries respond with their own legislation to European indications and what it is allowed to do concerning cannabidiol in our country.

According to European directives, no member country can prohibit CBD trade if produced following the law in a member country.

The Italian law of reference is number 242 of 2016, which officially entered into force the following year and regulates the cultivation, processing and trade of CBD.

Therefore, a law frames the entire supply chain, from the producer to the store, online or physical, which markets the product, except for the final consumer.

This law presents an objectively significant void, especially for private citizens, who can legally purchase the product but do not know what the permitted use is.

Therefore, law 242 highlights how it is possible to grow and sell cannabis with THC levels below 0.2% (in reality, the limit in Italy is slightly higher, however, the great majority of professionals stick to this European indication).

So, if there is a control, it’s always necessary to be able to prove the origin of the product, because as regards the seeds, for example, these must be among those included in the register specifically drawn up by the European Union.

However, as already highlighted, a piece is missing from Italian law. If it is possible in the cases indicated to cultivate, work, sell, and therefore buy CBD, what are the permitted uses?

There is no clear answer from the law in this sense. There are many citizens who therefore wonder if, for example, it is legal to smoke or inhale this product or how it can be consumed in order not to break the rules.

While waiting for Italy to answer these questions, the best thing for citizens is always to have the certifications of the products they buy with them in order to prove their origin and, therefore, their legality.

Because it is good to reiterate it, the sale and purchase of certified CBD are totally permitted by law in our country.

Cannabidiol is not a psychotropic substance. This means that it does not cause alterations or addiction. For this reason, it has been liberalized and, as reported by some scientific sites, it is also indicated for therapeutic purposes.
